"Schrems II": Ground zero of the legal quake
The upheaval stems from a landmark ruling delivered on July 16, 2020, by the Court of Justice of the European Union (CJEU), known as "Schrems II" (Case C-311/18). With this decision, the Court invalidated the Privacy Shield, the legal framework that governed personal data transfers between Europe and the United States.
The core issue does not lie within Google's technology itself, but rather with US surveillance laws, specifically FISA 702 and the Cloud Act. This legislation compels US electronic service providers to hand over user data to US intelligence agencies upon request. Because European citizens have no actionable legal recourse across the Atlantic, the CJEU ruled that their data was not safe, thus rendering the transfers illegal.
The European domino effect
Following this ruling, a wave of coordinated complaints was filed by the privacy advocacy group NOYB, forcing data protection authorities to rule on the specific case of Google Analytics. The domino effect was swift and severe:
- Austria paves the way: The Austrian Datenschutzbehörde (DSB) issued a decision on December 22, 2021 (published in January 2022), declaring the use of the tool illegal under the GDPR.
- France strikes hard: On February 10, 2022, the French CNIL issued resounding formal notices against French website managers. Its verdict was final: the technical measures proposed by Google were insufficient to protect French users' data from foreign intelligence services.
- Financial penalties hit: Italy, Denmark, and Finland quickly followed suit. On July 3, 2023, the Swedish authority (Integritetsskyddsmyndigheten or IMY) took it a step further by imposing a one million euro fine on the telecom operator Tele2 for its use of Google Analytics.
Overnight, thousands of companies found themselves forced to implement highly complex workarounds (such as proxy servers) or abandon the tool entirely.
The false promise of Google Analytics 4 (GA4)
In an attempt to reassure the market, Google forced a migration to Google Analytics 4 (GA4). Concurrently, a new political agreement, the Data Privacy Framework (DPF), was signed between the European Union and the United States in July 2023 to facilitate the resumption of data transfers.
